These Terms & Conditions ("Terms") govern your access to and use of Zorahair.com and your purchase or use of products and services offered by Zora Hair, Inc d/b/a Zora Hair ("Zora Hair," "Zora," "we," "us," or "our"). By using our Site or purchasing from us, you agree to these Terms.
You represent that you are at least 18 years old, or the age of majority in your jurisdiction, and capable of entering into a binding agreement.
You may use our Site only for lawful purposes and in accordance with these Terms.
You may not:
- use the Site in violation of any law or regulation
- interfere with the Site's operation, security, or functionality
- attempt to gain unauthorized access to accounts, systems, or data
- copy, scrape, reproduce, publish, distribute, or exploit Site content without our prior written consent
- use the Site or our products for unauthorized resale, diversion, or bulk commercial distribution
- submit false, misleading, or fraudulent information
We make reasonable efforts to describe and display our products accurately. However:
- human hair is a natural material and may vary in color, tone, texture, wave pattern, density, luster, and other characteristics
- minor variation between batches, bundles, or pieces is normal and not a defect
- your device settings, monitor quality, and lighting conditions may affect how products appear online
- product availability may change without notice
Zora Hair does not guarantee an exact shade, tone, pattern, or texture match unless expressly stated in writing.
Your order is an offer to purchase. An order confirmation email does not mean that we have accepted your order. We reserve the right to refuse, limit, cancel, or modify any order at any time for reasons including:
- inventory unavailability
- pricing, listing, or typographical errors
- suspected fraud or unauthorized payment activity
- incomplete, inaccurate, or unverifiable billing or shipping information
- suspected reseller or diversion activity
- legal or regulatory concerns
If we cancel an order after payment has been authorized or captured, we will issue the applicable refund.
Cancellation or change requests after an order is placed are not guaranteed.
All prices are displayed in U.S. dollars unless otherwise stated. Prices, promotions, discounts, and product availability may change without notice.
Promotions may be subject to separate terms and may not be combined unless expressly stated. Unless required by law, promotions do not apply retroactively. We reserve the right to correct errors in pricing, product descriptions, or promotional details, even after an order is submitted.
Applicable sales tax, use tax, duties, or similar charges may be added where required.
You agree to provide current, complete, and accurate billing and account information. By submitting payment information, you authorize us and our payment processors to charge the applicable amount, including taxes, shipping, and any properly disclosed additional charges.
Your purchase is also governed by our Shipping, Returns & Limited Warranty page, which is incorporated into these Terms by reference. If there is any conflict between these Terms and that page on a shipping, return, or warranty issue, the Shipping, Returns & Limited Warranty page controls.
Results with hair products vary based on installation method, styling, maintenance, products used, environmental conditions, and individual handling. You are responsible for following all care instructions and using reasonable care.
We are not responsible for damage caused by improper installation, misuse, improper storage, excessive heat, coloring, bleaching, toning, chemical processing, cutting, third-party salon services, adhesives, sewing, environmental exposure, or other post-delivery alterations or handling.
If you submit, upload, post, tag us in, or otherwise provide reviews, photos, videos, comments, testimonials, or similar content ("User Content"), you grant Zora Hair a non-exclusive, worldwide, royalty-free, transferable, sublicensable right to use, reproduce, modify, publish, display, distribute, and create derivative works from that User Content for advertising, marketing, ecommerce, social media, and business purposes.
You represent and warrant that:
- you own or control the rights to the User Content
- the User Content is accurate and not misleading
- the User Content does not violate any law or third-party right
- if another person appears in the User Content, you have all necessary rights and permissions
All content on the Site, including text, images, graphics, logos, product names, product descriptions, videos, design, trademarks, service marks, and other materials, is owned by or licensed to Zora Hair and is protected by applicable intellectual property laws.
Products purchased from Zora Hair are intended for personal use unless we have expressly authorized resale in writing. We reserve the right to reject or cancel orders we believe are placed for unauthorized resale, diversion, or marketplace listing.
If you opt in to receive marketing text messages from Zora Hair, you agree to receive recurring automated or autodialed promotional and personalized marketing text messages, including cart reminders if applicable, at the mobile number you provided.
By opting in, you represent that:
- you are the account holder or authorized user of the number provided
- your consent applies only to Zora Hair and not to any other seller or business
Consent to receive marketing texts is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to cancel and HELP for help. We may send you a confirmation text in response to your opt-out request. Carriers are not liable for delayed or undelivered messages.
We may suspend or terminate the SMS program at any time. Our Privacy Policy describes how we handle personal information collected in connection with the SMS program.
You agree that we may communicate with you electronically, including by email, text message, website posting, or account notice, and that such communications satisfy any legal requirement that communications be in writing.
Except for the 30-Day Limited Warranty for Manufacturing Defects expressly stated in our Shipping, Returns & Limited Warranty page, we make no additional express warranties regarding our products or services.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ANY IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO THE 30-DAY LIMITED WARRANTY PERIOD DESCRIBED IN OUR SHIPPING, RETURNS & LIMITED WARRANTY PAGE. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ZORA HAIR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THE SITE, YOUR PURCHASE, OR YOUR USE OF ANY PRODUCT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO A PRODUCT OR ORDER WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT OR ORDER GIVING RISE TO THE CLAIM.
SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
You agree to indemnify, defend, and hold harmless Zora Hair and its affiliates, owners, officers, directors, employees, contractors, service providers, and agents from and against claims, liabilities, damages, losses, and expenses arising out of or related to your violation of these Terms, your misuse of the Site, or your violation of any law or third-party rights.
Except to the extent prohibited by applicable consumer protection law, these Terms and any dispute arising out of or relating to the Site, your purchase, or our products will be governed by the laws of the State of Florida, without regard to conflict of law rules.
Except to the extent prohibited by applicable law, any dispute must be brought exclusively in the state or federal courts located in Hillsborough County, Florida, and you consent to personal jurisdiction and venue in those courts.
Before filing suit, you agree to send written notice of the dispute to hello@zorahair.com and allow 30 days for informal resolution.
We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last Updated" date. Your continued use of the Site after updated Terms are posted means you accept the revised Terms.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
